A draft of PEI's newest publication Recommended Practices for the Testing and Verification of Spill, Overfill, Leak Detection and Secondary Containment Equipment at UST Facilities (PEI/RP1200) is now available for comment.

The PEI Overfill, Release Detection and Release Prevention Equipment Testing Committee began work on this document over a year ago in anticipation that the U.S. Environmental Protection Agency (EPA) would strengthen the 1988 federal underground storage tank (UST) regulations by increasing the emphasis on properly operating and maintaining UST equipment. EPA did just that by proposing rules on November 18, 2011, that would establish periodic operation and maintenance requirements for UST systems.

The committee responsible for drafting the recommended practice agrees with EPA that UST equipment must be maintained, inspected and tested for proper operation on an ongoing basis to operate effectively and safely. The committee's recommended practice provides a concise summary of general guidelines for the inspection and testing of leak detection, release prevention and overfill prevention equipment at UST facilities. The information has been assembled from published and unpublished sources provided by equipment suppliers, experienced testing contractors, UST owners and operators, and authorities having jurisdiction.

The draft document and comment form are available at www.pei.org/rp1200. PEI accepts comments to its draft recommended practices from anyone with an interest in the subject. Online comments offering changes to the document must be received by March 26, 2012, to be considered by the PEI Overfill, Release Detection and Release Prevention Equipment Testing Committee. The Committee hopes to publish a final document by the end of summer.

LUNDBERG LETTER LOOKS AT 2012 RETAIL GASOLINE MARKET
The January 4, 2012, issue of the well-written and insightful Lundberg Letter offers  predictions about the retail gasoline market in 2012. These are Lundberg's, but we think they are right on target:

• Tough lending market. Continued difficulty in getting loans for ground-ups, upgrades, and especially lifelines for struggling retailers.
• As 2012 begins, retailers are passing through higher gasoline taxes to motorists due to the 45¢-per-gallon ethanol subsidy (passed through in wholesale as a 4.5¢-per-gallon price hike), so retail pump prices will be 4.5¢-per-gallon higher than they otherwise would have been. 
• Gasoline demand recovery due to pent-up demand and a good possibility of lower pump prices in 2012. Retail prices, currently more than 20¢-per-gallon below the 2011 average, may evolve into a lower-price year overall in spite of some adamant statements in the press predicting large price hikes this Spring.
• Costs of doing retail business. Increasing rents and utility bills require more margin.
• Costs of compliance. Regulatory costs rising on items like underground tanks and health care, plus legal costs to protect from and respond to "price gouging" witch hunts.
• Majors' retreats. They are handing station networks to jobbers, and both majors and jobbers are handing over company-ops to dealers. Many of these transformed retail businesses may prove unable to work on skinny margins.
• Hyper slowdown. Hypermarkets/big-box gasoline retailing is growing at a snail's pace overall.
